App terms of use
Last updated: 3 October 2026
These terms of use govern the use of the NotreContrat mobile app, published by [À compléter : nom et prénoms du ou des fondateurs], acting on behalf of NotreContrat, a company in the process of incorporation, by users located in Côte d’Ivoire. They are drawn up in accordance with Law No. 2013-546 on electronic transactions and Law No. 2016-412 on consumer protection. This English translation is provided for information only. In the event of any discrepancy, the French version prevails.
1. Purpose
NotreContrat offers parents, as well as adult pupils and students, a tutor matching their request, and lets tutors offer their services. It can also be used to formalise an existing relationship between a pupil and their tutor. The app calculates the price, lets the parties formalise the agreement and keeps track of lessons and payments.
In these terms of use, “parent” means the parent or legal guardian of a pupil who is a minor, as well as an adult pupil or student using the app on their own behalf.
2. Acceptance
Creating an account means full acceptance of these terms of use, which the user acknowledges having read beforehand. The terms of use are available at any time in the app and on the website.
3. Registration
- Registration is reserved for individuals who have reached the age of legal majority and have legal capacity. A pupil who is a minor cannot register: their parent or legal guardian acts on their behalf.
- Users provide accurate, up-to-date information and undertake to keep it up to date.
- Each user may hold only one account; login details are personal and confidential.
- When registering, the user confirms their phone number with a code sent by text message, then chooses a personal PIN code. They can also enable their phone’s fingerprint or face recognition. This PIN code or recognition is used to confirm agreements. If the PIN code is forgotten or the phone is replaced, the user can reset it after an identity check.
- An identity check is carried out before the relevant profiles are approved. NotreContrat may refuse or suspend a profile that fails verification.
4. How the service works and NotreContrat’s role
Pupil profile. The parent records the pupil’s profile in their account, including their class or level of study (for example CM2, seconde C or second year of a bachelor’s degree). A parent can record several children; an adult pupil or student fills in their own profile.
Tutor request. From the “Get a tutor” section, the parent enters the subject or subjects, the number of hours, the format (online or in person) and, for in-person lessons, the place of the lessons. The information in their account is used automatically.
Proposal. The app sends the request to available tutors whose profile matches (subjects, levels, format, area); each tutor is free to accept or not. The parent is then offered a tutor, with their profile and the price calculated under section 5. The proposal takes into account how well the tutor matches the request, availability, distance for in-person lessons and the tutor’s ratings. The parent can accept it or ask for another proposal.
Existing relationship. A parent or adult pupil who already takes lessons with a tutor can formalise that relationship in the app. Once their accounts are created, the two parties link them: one scans the other’s QR code, or enters the invitation code the other has sent them, which is single-use and valid for a limited time. One party then enters the terms of the lessons (subjects, number of hours, format, place and times), which the other accepts. The price is calculated by the app according to the price scale in section 5; it is not negotiated between the parties. The agreement then follows the same rules as any other agreement: confirmation, payment, lesson verification and ratings.
No messaging. The app has no messaging between users: the terms of the lessons are set by the request and summarised in the agreement. Once the agreement is confirmed, each party receives the information needed for the lessons (address of the lessons or access to the online lesson).
NotreContrat acts as a technical intermediary. The agreement is made directly between the parent and the tutor. The price is set by NotreContrat according to the price scale described in section 5, and the payment is held until the lessons have been verified, under the conditions of section 7. NotreContrat is not a party to these agreements, is not the tutors’ employer and guarantees neither the teaching quality of the lessons nor academic results.
Tutors working professionally are responsible for meeting their own tax and social security obligations.
5. Pricing
The price of lessons is set by NotreContrat according to a common price scale, applied in the same way to all users in the same situation. It is not negotiated between the parent and the tutor.
The price is calculated on the basis of the following criteria:
- the level taught (primary, lower secondary, upper secondary or university) and, where applicable, exam or competitive exam preparation (CEPE, BEPC, baccalauréat, university exams, competitive exams);
- the number of subjects taught;
- the frequency of lessons and the number of hours per week or per month;
- the format: at home, online or in another place agreed between the parties;
- for in-person lessons, the pupil’s municipality of residence and the distance travelled by the tutor, which determine travel costs; no travel costs apply to online lessons;
- the number of pupils taught in the same lesson (one-to-one or group lessons, for example for siblings);
- the tutor’s verified qualifications and experience;
- special times (evenings, weekends, public holidays) and intensive periods (exam revision, school holidays);
- the length of the commitment (single lesson, month, term).
Before any confirmation, the app displays the total price in CFA francs (FCFA), including all taxes, together with a breakdown: price of the lessons, travel costs where applicable and the NotreContrat service fee. This summary is included in the agreement confirmed by the parties, in accordance with the price information obligations of Law No. 2016-412 on consumer protection.
The current price scale is available at any time in the app. Changes to it do not apply to ongoing agreements: they apply to new agreements and renewals, after users have been informed.
Any change to the terms of an agreement (subjects, number of hours, format, place of lessons) leads to a new price calculation, which both parties must confirm.
By offering their services in the app, tutors accept that the price of their lessons is set according to this price scale.
6. Formalising agreements
Each agreement is summarised in the app before it is confirmed, with the price and its breakdown. Each party confirms it with their PIN code, fingerprint or their phone’s face recognition; the tutor confirms the declaration set out in section 9 at the same time. Confirming the agreement triggers the payment described in section 7.
The parties acknowledge that this confirmation expresses their consent and that the resulting electronic document has the same evidential value as a paper document, under the conditions set out in Law No. 2013-546 of 30 July 2013 on electronic transactions. A copy of the agreement remains available in the app.
7. Payment, lesson verification and payout to the tutor
NotreContrat is not a payment institution, an electronic money institution or a credit institution. Payments are processed by mobile money operators and by [À compléter : nom de l’établissement de paiement ou de la banque partenaire, agréé(e) par la BCEAO], an institution licensed by the Central Bank of West African States (BCEAO), in accordance with Regulation No. 15/2002/CM/UEMOA and Instruction No. 001-01-2024 on payment services in the WAMU. The amounts paid by parents are held by this institution in a dedicated account, separate from NotreContrat’s own accounts, until they are paid out to the tutor or refunded. NotreContrat sends payout and refund instructions according to the rules set out in the terms of use and does not use these amounts on its own behalf.
Payment. The contract amount is paid by mobile money according to the schedule chosen in the agreement: in full on signature, in instalments (for example every week or every month) or lesson by lesson. Each amount paid is withheld at source: it is not paid to the tutor immediately but held as described above until the lessons concerned have been verified.
Lesson verification. Each lesson is confirmed with a single-use lesson code, valid for a few minutes, which the parent or adult pupil gives to the tutor at the end of the lesson. The tutor enters it in their app, which confirms the lesson.
- In-person lessons: the code appears in the parent’s or adult pupil’s app when their phone and the tutor’s phone are within 200 metres of the lesson location, during the scheduled time slot.
- Pupil who is a minor and goes to the lesson alone: the parent can get the code remotely and give it to the pupil, who passes it on to the tutor. The code is then only accepted if the tutor enters it from the scheduled lesson location, during the scheduled time slot.
- Online lessons: the lesson is confirmed with a cross-code. At the end of the lesson and during the scheduled time slot, the tutor’s app and the parent’s or adult pupil’s app each display a code that changes every minute. The two parties read their codes to each other during the lesson and each enters the other’s code; both entries must be made within the same minute. A pupil who is a minor makes this exchange from their parent’s app.
- If no code can be used (for example because of a network problem), the tutor can record the lesson in the app; the parent or adult pupil then confirms or disputes it within 3 days, failing which it is deemed delivered.
Payout to the tutor. The amount for confirmed lessons is automatically paid into the tutor’s mobile money account registered in the app, minus the NotreContrat service fee, at the frequency set in the agreement: at the end of each lesson, every week or every month.
Disputes and refunds. If a lesson is disputed, the corresponding amount remains blocked while NotreContrat reviews the dispute; NotreContrat may ask both parties for evidence before deciding on payout or refund. A lesson that was not delivered is refunded to the parent’s paying account. When the agreement ends or is terminated, amounts for lessons not delivered are refunded to the parent.
- Amounts are expressed in CFA francs (FCFA).
- Mobile money payments are subject to the terms of the operator chosen by the user, including any transaction fees.
- Cash payments are not covered by this mechanism: they can only be recorded in the app for tracking purposes. Such records are declarative, confirmed by both parties, and do not constitute a payment guarantee from NotreContrat.
- NotreContrat service fee: [To be completed: free of charge, or amount/percentage of the service fee].
- NotreContrat does not withhold any tax from the amounts paid to tutors, unless a law in force requires it. Tutors remain responsible for the tax and social security obligations relating to the amounts they receive.
8. Ratings and tutor profiles
After lessons, the parent or adult pupil can give the tutor a rating of one to five stars, based on the quality of the service. Ratings must be honest and relate only to the lessons.
The tutor’s profile shows in particular their subjects and levels, verified qualifications, experience, the number of pupils taught, their average rating and the number of ratings received. This information is calculated by the app from the lessons delivered.
NotreContrat may remove a rating that is clearly abusive, fraudulent or unrelated to the lessons. Tutors can report a rating they consider unjustified.
9. Users’ commitments
Each user undertakes to:
- use the app in accordance with the law and these terms of use;
- not publish any false, misleading, abusive or discriminatory content, or content that infringes the rights of others, and give honest ratings;
- not impersonate anyone or present false qualifications;
- not circumvent the app’s confirmation and security mechanisms;
- honour their commitments to the other party.
Tutors also undertake to behave impeccably towards pupils who are minors at all times.
Tutors who teach at a school undertake not to use the app to give paid lessons to their own pupils, including when formalising an existing relationship in the app, in accordance with service note No. 1076/MENAET/DELC/Secrétariat of 1 October 2026 issued by the Ministry of National Education and Literacy, which prohibits teachers from giving paid remedial lessons to their own pupils. This prohibition does not cover tutoring other pupils. NotreContrat may ask tutors to state the school where they teach and may refuse or suspend any agreement that breaches this rule.
Tutor’s declaration. Before confirming each agreement, the tutor ticks the following statement, then confirms it with their PIN code or their phone’s biometric recognition: “I declare on my honour that I am not this pupil’s teacher at their school, and I take full responsibility for this declaration.” The tutor is solely responsible for the accuracy of this declaration. Any false declaration leads to the immediate suspension of their account and may be reported to the competent authorities.
Tutors also comply with the rules specific to their status, including, for public servants, the rules on holding several jobs.
10. Protection of minors and reporting
Any inappropriate behaviour towards a pupil can be reported in the app or to contact@notrecontrat.com. NotreContrat may immediately suspend the account concerned and, where appropriate, refer the matter to the competent authorities.
11. Liability
NotreContrat takes reasonable measures to keep the app accessible and secure, without guaranteeing uninterrupted availability. NotreContrat cannot be held liable for the performance or non-performance of agreements between users, or for incidents occurring when a third-party operator processes a payment.
These limitations do not deprive consumer users of their rights under Law No. 2016-412 on consumer protection.
12. Suspension and termination
Users can close their account at any time from the app. NotreContrat may suspend or close an account in the event of a breach of these terms of use after informing the user, or immediately in the event of a serious breach (fraud, endangering a minor). Agreements already confirmed remain governed by their own terms; amounts held are paid out to the tutor or refunded to the parent under the rules of section 7.
13. Personal data
The processing of personal data is described in the privacy policy, which forms an integral part of these terms of use.
14. Complaints and disputes
Any complaint can be sent to contact@notrecontrat.com. The parties will try to settle any dispute amicably before taking legal action.
These terms of use are governed by Ivorian law. Failing an amicable settlement, the dispute will be brought before the competent Ivorian courts, subject to consumer protection provisions.
15. Changes to the terms of use
NotreContrat may change these terms of use. Users are informed in the app of any significant change before it takes effect; continued use of the app means acceptance of the new terms.
